However, hiring security personnel is advisable in an operational environment: incidents such as break-ins or vandalism disrupt operations, can cause production delays or even plant shutdowns and are often associated with contractual penalties and loss of sales. A security service commissioned for plant security is above all bound by instructions and is authorised by the client. In principle, the plant security staff enforce the company's domiciliary rights; however, the specialists have no sovereign powers like the police. In the event of an attempted unauthorised intrusion, the security staff may make a temporary arrest based on the Everyman's Right (BGB) - but only until the police arrive.

Plant security requires specialists who can continuously assess situations correctly and have a good knowledge of human nature. Plant security staff require specialised training. Every external specialist must therefore have information required according to § 34a GewO prove.

Which laws and regulations actually govern plant security? The focus here is on §34a of the trade regulations (§ 34a GewO for short). The strict legal requirements for authorisation ensure a high level of integrity on the part of security specialists and security for companies. Only those who fulfil the requirements may offer plant and property protection. The same applies to patrol services, event security or the transport of money and valuables.
The guarantor obligation (legally known as the guarantor position) is of crucial importance for the work of plant security. It is based on Section 13 of the German Criminal Code. In it, the legislator describes offences committed by omission. Specifically, it states that omission can be penalised if it is contrary to duty.
